The people’s right to know the process of governmental decision-making, including the facts and statistics leading to such determinations, is fundamental to our democracy. It shall not be thwarted by hiding information behind the shield of confidentiality or secrecy. This article is intended to ensure that the public may inspect, without charge or privilege, the records of state agencies.
Any person who, with intent to prevent the inspection of a record pursuant to this article, shall conceal or destroy the same or attempt to do so shall be guilty of a misdemeanor. (a) When an agency maintains records electronically that include items that would be available to the public, as well as those that are not available to the public, the agency shall in designing its information retrieval methods, whenever practicable and reasonable, segregate such items and make them separately available.
